Who Pays for HOA and Condo Documents?

Aloha Maui Property Owners,

Just a quick administrative update for Maui property sellers. The standard Hawaii Purchase Contract spells out that the Sellers are responsible for paying for Homeowner’s Association Documents, CC&R’s and Condo Documents during escrow. Historically these documents were ordered and ultimately paid for at the close of escrow out of the proceeds from the sale of the property. Since market conditions have changed in Hawaii, several of the management companies are requiring payment for these documents up front. These fees usually run from approximately $100 to $500. It is a relatively small expense, but one worth noting when preparing your property for sale.
