Honua’ula Hits Legal Road Blocks

According to today’s Maui News, the proposed Honua’ula development has hit a legal road block. Maui County Circuit Judge Joseph Cordoza has issued an injunction on further county discussion of the project until Cordozza has an opportunity to rule on whether the County Council violated Sunshine Laws during the county zoning review process. A group of South Maui residents filed a suit arguing that the county council failed to grant adequate opportunity for public comment on the project during the zoning review process. The County Council and Mayor Tavares approved the zoning in March and Early April respectively. The county had since moved towards the second phase of the approval process.

Circuit Court Judge Cordoza granted the injunction on the belief that the plaintiffs may have a case. The plaintiffs are asking that the mayor’s approval of the zoning bills be rescinded and that the planning commission reopen the meetings with more opportunity for public comment and the communications among the council be more open to the public.
